Appendix I (Withdrawal Form)

1. General Terms / Scope of Application

1. These General Terms and Conditions (hereinafter "GTC") apply exclusively to the business relationship between Tamara Dogan, owner and operator of the online store www.stardustacrylics.com, Margaretendamm 12, 6923 Lauterach, Austria (hereinafter "Stardust Acrylics"), and you (hereinafter "Customer") as the user of the online store www.stardustacrylics.com. These terms are binding for all orders placed via the website www.stardustacrylics.com.

2. Tamara Dogan operates a sole proprietorship not registered in the commercial register, based in Lauterach, and holds the necessary business license for online retail (excluding regulated trades).

3. The current version of these GTC can be downloaded and printed from www.stardustacrylics.com.

4. Stardust Acrylics reserves the right to amend these GTC in accordance with § 16.

5. It is assumed that these GTC have been read prior to using the website or placing any orders. If any parts of these GTC are unclear, customers are advised to contact Stardust Acrylics for clarification.

6. Please note: by using the website—especially when placing an order—you agree to these GTC. If you do not agree to them, you are prohibited from using the website or ordering products.

7. The customer agrees that communication with Stardust Acrylics may take place electronically, particularly via email. This applies in particular to contractual information, invoices, order confirmations, or legally relevant notices. This includes, but is not limited to, information regarding orders, invoices, contractual changes, and notifications regarding your rights.

8. An English version of these GTC is provided for informational purposes only. In the event of discrepancies or interpretative questions, only the German version is legally binding.

1a. Special Provisions for Business Customers (B2B)

These GTC apply to both consumers and business customers unless explicitly stated otherwise.
The following additional provisions apply to business customers:

a) No right of withdrawal: Business customers are not entitled to a statutory right of withdrawal.

b) Transfer of risk: The risk of accidental loss or deterioration of goods passes to the business customer upon delivery to the shipping carrier.

c) Obligation to inspect and report defects: Business customers must report any obvious defects in writing within 7 days of receiving the goods. Failure to do so will result in the goods being deemed accepted (§ 377 German Commercial Code – HGB).

d) Liability: Our liability to business customers is limited to intent and gross negligence, except in cases of breach of essential contractual obligations (cardinal obligations). In cases of minor negligence involving such obligations, liability is limited to typical and foreseeable damages.

e) Place of jurisdiction: For contracts with business customers, the exclusive place of jurisdiction is our business location in Bregenz. Austrian law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

f) Packaging ordinance (applicable only to customers based in Austria):
Business customers based in Austria agree, by placing an order, to assume full responsibility for complying with all obligations related to the collection, return, and recycling of packaging materials delivered by STARDUST ACRYLICS, pursuant to § 13g AWG in conjunction with the Packaging Ordinance. This includes the obligation to participate in a suitable collection and recycling system under § 13h AWG. The customer agrees to independently and timely fulfill all reporting and exemption obligations. Stardust Acrylics assumes no responsibility for compliance with these legal requirements.

2. Orders / Registration / User Account / Guest Checkout

1. Registration for our online shop is free of charge. There is no legal entitlement to registration. Only individuals with full legal capacity (minimum age: 18) are eligible to register. Upon request, you are obliged to provide a copy of your official identification document for verification.

To register, please complete the online registration form available on our website and submit it electronically. All required information must be provided accurately and in full. During the registration process, you will choose a personal username (your email address) and password. The username must not infringe upon third-party rights, trademarks, or public decency. You are responsible for keeping your password confidential and must not disclose it to third parties under any circumstances.

2. Alternatively, you may place orders as a guest without creating a user account. In this case, no registration is required.

3. Other than agreeing to these General Terms and Conditions, registration does not entail any obligations. If you wish to delete your user account, please contact us at office@stardustacrylics.com. Registration alone does not constitute any obligation to purchase the products we offer.

4. If your personal information changes, you are responsible for updating it accordingly. You may edit your data at any time after logging into your account under “My Account.”

5. STARDUST ACRYLICS reserves the right to permanently block or delete customer accounts in cases of suspected misuse, repeated returns, or violations of these GTC. This also applies to the use of technical manipulations or automated systems for accessing or interacting with our online shop.

3. Conclusion of Contract

1. The presentation of our products does not constitute a binding offer by STARDUST ACRYLICS, but rather a non-binding online catalog. By clicking the button “PLACE ORDER WITH OBLIGATION TO PAY”, you submit a legally binding offer to purchase the products in your shopping cart (hereinafter referred to as the "Order").

2. After receiving your Order, we will send you an email confirming receipt of the Order and listing the details (Order Confirmation).
Please note: this Order Confirmation does not constitute acceptance of your offer by STARDUST ACRYLICS. It serves solely to inform you that your Order has been received.

The conclusion of the purchase contract depends on your selected payment method:

Credit Card (VISA/MasterCard): upon clicking the order button
PayPal: upon clicking the order button and successful payment authorization
Prepayment (bank transfer): upon clicking the order button and receipt of the payment instructions with bank details from STARDUST ACRYLICS
Sofort (instant transfer): upon clicking the order button and confirmation of payment
Klarna Invoice: upon clicking the order button and confirmation of payment
Klarna Pay Now: upon clicking the order button and confirmation of payment
Shop Pay: upon clicking the order button and successful authorization through your Shop Pay account
Apple Pay: upon confirming the payment using Face ID, Touch ID, or code on your Apple device, and clicking the order button

Shipping will only take place after the full amount has been credited to our account (for prepayment and Sofort payments). If your order is shipped in more than one package, you may receive a separate shipping confirmation for each. In such cases, a separate purchase contract is concluded for the products listed in each individual shipping confirmation.

Notwithstanding your statutory right of withdrawal under § 4, you may cancel your order free of charge at any time before the corresponding shipping confirmation has been sent.

1. STARDUST ACRYLICS is under no obligation to accept your offer and may decline it without stating reasons. In this case, you will be promptly informed via email, and any payments already made will be refunded in full.

2. The essential characteristics of the products offered and the duration of limited-time offers can be found in the individual product descriptions on our website.
If a price on the website is incorrect, STARDUST ACRYLICS will inform you by email and cancel the order. If payment has already been made, the amount will be refunded in full.

3. You can review and correct any input errors before placing your order on the final confirmation screen using the edit and delete functions.

4. We store the data required for processing your order and contract. You may access this information at any time. For details, please refer to our Privacy Policy as outlined in § 11 of these GTC.

5. We sell only in household quantities.

6. Free shipping for orders over €50.00 within Austria.

7. The contract language is German only.

3a. Consumer Information according to FAGG (Austrian Distance and Off-Premises Sales Act)

This consumer information is based on the Austrian Distance and Off-Premises Sales Act (FAGG) and applies only within the legal framework of Austria.

In accordance with § 4 FAGG, STARDUST ACRYLICS provides the following mandatory information:

The essential characteristics of the goods are specified in the respective product descriptions on the website.
The contract language is exclusively German.
The technical steps for contract conclusion and any correction options are outlined in § 3 of these GTC.
Information about the right of withdrawal is provided in § 4 of these GTC.
Further details regarding payment, delivery, and fulfillment can be found in §§ 7 to 9 of these GTC.

4. Right of Withdrawal for Consumers

As a consumer – i.e. a natural person who places an order for purposes that are predominantly outside their trade, business, or profession – you have the right to withdraw from this contract. A sample withdrawal form is provided at the end of this notice.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without stating any reason.
The withdrawal period is fourteen (14) days from the day on which you or a third party designated by you (who is not the carrier) takes possession of the goods.

by means of a clear declaration (e.g. by post or email) of your decision to withdraw from the contract. You may use the sample withdrawal form attached, but this is not mandatory.

If you choose to exercise this option, we will confirm receipt of your withdrawal without delay (e.g. via email).
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen (14) days from the day on which we receive notice of your withdrawal.

We will use the same means of payment for the refund as you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for the refund.

We may withhold the refund until we have received the returned goods or until you have provided proof that you have sent back the goods, whichever is earlier.

You must return the goods without undue delay and in any event no later than fourteen (14) days from the day on which you inform us of your withdrawal, to:

The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this is due to handling that is not necessary to ascertain the nature, characteristics and functioning of the goods.

Exclusion of the Right of Withdrawal

Please note that the right of withdrawal does not apply to certain goods, in particular:

Customized or personalized items (§ 18 FAGG)
Goods that can spoil quickly or whose expiry date would be rapidly exceeded
Sealed items that are not suitable for return for health protectoin or hygiene reasons once unsealed
Goods which,, which after delivery, are inseparably mixed with other items

Other statutory exceptions under § 18 FAGG (Distance and Off-Premises Contracts Act) also apply.

Return Instructions

We kindly ask you to return the goods in their original condition – including all accessories and, if possible, in the original packaging.
This ensures efficient and safe processing of your return.
This is not a requirement for the effective exercise of your right of withdrawal.

Data Protection Notice

We process your personal data solely for the purpose of handling and fulfilling your withdrawal request.

5. Returns & Refunds

1. Before returning any products, please ensure they are carefully and securely packaged. If proper packaging is not possible, please contact us to arrange collection. Returns from outside the EU must be clearly marked as ‘Returned Goods – No Commercial Value’ to avoid unnecessary customs charges. Failure to do so may result in refusal of the return shipment.

1. You may use our online return form or the sample withdrawal form provided in Annex I.

2. Returned products, including their packaging, must be in unopened, original condition and show no signs of use. We strongly recommend retaining proof of shipment for all returns. A refund will only be issued once we have verified that the returned item is unopened and in its original condition.

3. The right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed.

4. The right of withdrawal does not apply to goods that, due to their nature, have been inseparably mixed with other items after delivery.

5. Unless otherwise agreed, delivery is made under Incoterms 2020 "EXW – Ex Works" from our warehouse. Transportation costs and the risk of damage or loss transfer to the buyer upon handover to the shipping provider. We will do our best to assist in the event of shipping issues but accept no liability for damages or delays occurring after dispatch.

6. There is no minimum order value. Orders are generally shipped as a single package; partial deliveries are not made. In-store pickup is not possible for logistical reasons.

6. Product Images

The product images on this website are for illustrative purposes only and are intended to give a general idea of the products. While we strive to display colors as accurately as possible, we cannot guarantee that your device’s display reflects the true color of the products. Therefore, the delivered product may slightly differ from the images shown.

The products offered are cosmetics within the meaning of the EU Cosmetics Regulation (Regulation (EC) No. 1223/2009) and are duly registered in the Cosmetic Products Notification Portal (CPNP). Our products are not intended as pharmaceuticals, medical devices, or for end consumers. They are designed exclusively for professional users in the field of nail design.

Product packaging and labeling may differ slightly from images displayed online, depending on regional regulatory requirements.

7. Product Safety / Application Instructions

Our products are strictly intended for professional use by trained nail technicians. Use is at the user's own risk. Not suitable for private consumers. Use by trained professionals only. STARDUST ACRYLICS accepts no liability for off-label use.

Our acrylic powders and liquids are systemically coordinated. Combining them with products from other manufacturers is at your own risk and may lead to undesired results or material incompatibilities.

STARDUST ACRYLICS assumes no liability for damages resulting from improper use, mixing with third-party products, or disregard of product instructions.

The customer is obliged to test the products for compatibility before commercial use.

8. Pricing & Shipping Costs

1. All prices listed by STARDUST ACRYLICS include statutory VAT unless otherwise stated, but exclude shipping costs. The final price, including shipping, is shown during the checkout process.

2. Shipping costs for orders outside the European Union (EU), European Economic Area (EEA), or Switzerland will vary by destination.

3. Please note that customs duties and import fees may apply for deliveries to destinations outside the EU. These charges are not included in our shipping rates. Our products are shipped duties unpaid (DDU), meaning we cover transport costs but not customs or import duties. You are responsible for paying these charges directly to the relevant authorities.

4. Promotional prices and special offers are only valid for the specified period or while stocks last.

5. According to §6 Abs. 1 Z 27 UStG, we are subject to the Austrian small business regulation. Therefore, our prices do not include VAT. Prices shown during checkout represent the final amount due. No additional taxes or fees will be added at checkout for EU orders.

9. Payment Terms / Retention of Title

1. We generally accept the following payment methods: credit card (VISA and MasterCard), Klarna, Shop Pay, Apple Pay, and Sofortüberweisung.
We reserve the right, on a case-by-case basis, not to offer certain payment methods and to refer to alternative ones.

2. STARDUST-ACRYLICS accepts credit cards issued by VISA and MasterCard. Payment processing is carried out via an external payment service provider. After entering your credit card details, an additional confirmation screen from your bank will appear showing the full payment information. You must complete your bank’s authentication process and confirm the transaction using the relevant security code. For further information, please contact your bank. The customer shall bear any additional costs incurred due to their own fault in using the selected payment method, e.g., chargeback fees. In the case of credit card payment, your card will be charged upon clicking the “Place order” button.

3. If you select PayPal as your payment method, you will be redirected to PayPal at the end of the checkout process. There, you can log in or register and follow the instructions provided by PayPal. Your PayPal account will be charged immediately with the purchase amount.

4. Payments via Shop Pay and Apple Pay are processed through the provider Shopify Payments, operated by Stripe Payments Europe Ltd., The One Building, 1 Grand Canal Street Lower, Dublin 2, Ireland. The respective payment and privacy policies of these providers apply.

5. If you choose to pay in installments via Klarna (available only up to a total order value of €5,000 and subject to a positive credit check; minimum order value €5), the Klarna Installment Plan is a so-called annuity loan granted by Klarna AB, Norra Stationsgatan 61, 11343 Stockholm (www.klarna.com). The monthly payment amounts of the annuity loan may vary based on interest rate changes. The monthly amount and/or loan term is determined by usage level and repayment amounts. The standard Klarna installment plan has an indefinite duration, while promotional plans may vary in duration (e.g., 3, 6, 12, 24, or 36 months). Account maintenance fees are €1.95 per month. You may repay the loan in full or in part at any time. The number and amount of installments will be specified in your loan contract, which will be sent to your registered address. Repayment under the standard Klarna plan must be at least 1/24 of the total debt per month, but not less than €6.95. Therefore, the number of installments depends on your payment behavior.
The variable annual interest rate under the standard Klarna plan is 14.95%. For example, a €1,500 loan repaid over 12 months with a monthly fee of €1.95 results in an effective annual interest rate of 18.1%. Under promotional Klarna plans, the effective interest rate varies according to the terms provided by Klarna AB at the time of contract conclusion.

You agree to receive invoices and credit notes exclusively in electronic form.

Purchase on account via Klarna is available for orders up to €1,500, subject to a positive credit check.

6. Please note that we do not cover any bank transaction fees for payments made from accounts outside the European Union (EU) or European Economic Area (EEA).

7. The goods remain our property until full payment has been received.

8. We make use of the small business regulation in accordance with § 6 (1) Z 27 UStG. Therefore, no VAT is charged.

10. Delivery Conditions and Delivery Times

1. Deliveries are made exclusively within Austria and the European Union, including Switzerland.

2. STARDUST-ACRYLICS ships the ordered products at its discretion using appropriate shipping service providers, such as Österreichische Post (Austrian Post), to the delivery address you provided. Unless otherwise agreed, delivery will be made to the address specified by you (delivery address) during regular business hours.
If you order multiple products at the same time, each order constitutes a separate contract, and the deliveries are generally dispatched separately. However, such orders may be combined into one consolidated shipment at our discretion. You will not incur any additional costs as a result.

3. Any applicable shipping costs are listed in the product description and will be shown separately on the invoice.

4. Any stated delivery times are non-binding and provided for reference only. Delivery times are estimated and not guaranteed. Delays due to customs or carrier issues are outside our responsibility.

11. Warranty

1. The statutory warranty provisions apply.
Liability for damages by STARDUST-ACRYLICS is limited in accordance with section 12.

2. If STARDUST-ACRYLICS grants additional guarantees, your statutory warranty rights remain unaffected.

3. STARDUST-ACRYLICS makes no guarantee that the website/webshop will be available without interruption or errors at all times.

Warranty claims must be submitted in writing to: info@stardustacrylics.com within a reasonable period after discovering the defect.

12. Data Protection

Protecting your privacy is of great importance to STARDUST-ACRYLICS.
When using our website, it is necessary to collect and process certain personal data. Please refer to our Privacy Policy, available at https://stardustacrylics.com/policies/privacy-policy, to learn which personal data STARDUST-ACRYLICS collects and how and for what purposes it is processed.
Please note that third-party tools (e.g., TikTok, Facebook) may also be used on our website for marketing and analytics purposes. Further information can be found in our Privacy Policy.

We comply with the EU General Data Protection Regulation (GDPR). For more information, please refer to our full Privacy Policy.

13. Liability

1. Due to the current state of technology, data communication via the internet cannot be guaranteed to be error-free and/or available at all times.
STARDUST-ACRYLICS accepts no liability for the continuous or uninterrupted availability, content accuracy, or virus-free nature of its online system, especially in circumstances beyond the control of STARDUST-ACRYLICS, such as internet disruptions or force majeure.

2. If availability of our website/webshop is temporarily interrupted – noting that STARDUST-ACRYLICS will limit maintenance and development periods to the necessary minimum – we shall not be liable for any data loss or resulting damages unless caused by intent or gross negligence.

3. STARDUST-ACRYLICS is fully liable for damages caused by STARDUST-ACRYLICS resulting in injury to life, body, or health, as well as for any damages caused intentionally or through gross negligence.
In cases of slight negligence, liability is only assumed for breach of essential contractual obligations (so-called cardinal obligations), and such liability is limited to typical and foreseeable damages. Cardinal obligations are those which the contract intends to impose on STARDUST-ACRYLICS according to its purpose, or those which are essential for proper performance of the contract and on whose compliance the customer may reasonably rely. STARDUST-ACRYLICS is not liable for slightly negligent breaches of duties other than the ones mentioned above. Liability under the Product Liability Act remains unaffected.

4. The above liability rules also apply to vicarious agents and legal representatives of STARDUST-ACRYLICS. They apply to all contractual and statutory claims, including those arising in tort. This limitation of liability shall also apply in favor of our employees, representatives, and agents.

14. Disclaimer for External Links

STARDUST-ACRYLICS provides links to third-party websites on its own website and expressly states that it has no influence over the design or content of the linked pages. Therefore, STARDUST-ACRYLICS expressly distances itself from all content of any third-party websites linked to its site and does not adopt their content as its own. This disclaimer applies to all links on this website and to all content of the sites to which these links refer.

15. Copyright

All copyright-protected material used and displayed by STARDUST-ACRYLICS on its website may only be used by the customer for private purposes. Copyrighted material belonging to third parties, which STARDUST-ACRYLICS uses to present its products, may not be used by the customer for their own purposes beyond private use.

16. Online Dispute Resolution

As a consumer, you have the option to resolve disputes relating to the purchase of our products via online dispute resolution.

We are neither obligated nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

17. Final Provisions

1. Amendments or additions to these terms and conditions must be made in writing. This also applies to any waiver of the requirement for written form.

2. Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you placed your order as a consumer and were habitually resident in another country at the time of your order, the mandatory legal provisions of that country remain unaffected by this choice of law.

3. If the customer is a business as defined by § 1 of the Austrian Consumer Protection Act (KSchG), the place of jurisdiction for any disputes arising from these terms and conditions shall be the registered seat of STARDUST-ACRYLICS. This agreement on jurisdiction does not affect the validity of mandatory consumer protection laws in the country where you reside.

4. STARDUST-ACRYLICS reserves the right to modify the website, policies, and these terms and conditions at any time for valid reasons, especially due to changes in law, regulatory requirements, or other significant reasons. Each purchase is subject to the version of the General Terms and Conditions in force at the time of the order.

5. Should any provision of this contract be invalid or contrary to statutory provisions, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that best reflects the economic purpose of the invalid clause. The same applies in the case of contractual omissions.

6. If these General Terms and Conditions are provided in multiple languages, only the German version shall be legally binding for all legal interpretations.
